How We Can Help You
Under Section 722 of the bankruptcy code, it is possible for a debtor in bankruptcy to redeem (pay the full amount of the outstanding loan) and keep a vehicle. Of course, the problem for debtors is that they do not have the cash on hand to pay for the redemption.
There are two ways McKinney & Associates, P.C. helps clients in this situation:
Redemption — we work with lenders who are willing to pay off the existing loan and issue a new loan on the value of your vehicle. The original debt is cleared and a new loan is issued for a lesser amount and possibly with a lower interest rate.
Reaffirmation — we can also work with the existing lender to seek a reaffirmation. This lowers the outstanding loan amount and possibly the interest rate.
With both a car redemption and a reaffirmation, you get debt relief and can continue to drive the vehicle you have grown accustomed to. It sure beats having to shop around for another vehicle too.
Experienced Bankruptcy Attorneys
McKinney & Associates, P.C., has helped over a thousand people like you get debt relief through the bankruptcy process.
We can review your situation and recommend the right solution for you. This could be a Chapter 7 bankruptcy which has the power to entirely eliminate most or all unsecured debts, or a Chapter 13 bankruptcy which can reduce some debts and enable you to pay off your remaining debts through a three to five year payment plan.
McKinney & Associates, P.C., can obtain a redemption or reaffirmation agreement under either Chapter 7 or Chapter 13, and work to help you get a fresh financial start through the bankruptcy process.
